The Florida representative told reporters Benjamin “decided to try to harass me as I was leaving my hearing with Rubio and smacked my arm,” adding that while she welcomes questions, “the moment you touch me, you cross a line.” Video documentation from multiple angles shows Benjamin tapping Luna’s arm, apparently attempting to gain her attention during an ongoing conversation between the two parties.

Luna had engaged directly with Code Pink activists before the contact occurred. The interaction ended when Luna threatened to involve Capitol Police, prompting Benjamin to agree to leave. Despite the minimal nature of the physical contact visible in footage, Luna characterized the incident as a “physical hit” requiring criminal prosecution.

In a subsequent interview with TMZ, Luna doubled down on her intention to file charges. “There’s footage of this, they have multiple angles of this, there was multiple witnesses, we have people that filed statements as well, and I think that she’s going to be getting in a lot of trouble,” Luna stated. She framed the incident within broader concerns about political violence, saying Americans increasingly believe “they can hurt people because they disagree with them politically.” When asked whether Benjamin would face arrest, Luna responded affirmatively: “Yes, without a doubt. You cannot hit people because they disagree with you.”
