U.S. District Judge David Estudillo rejected the temporary restraining order sought by Ari Hoffman of AM 570 KVI’s “Seattle’s Conservative Talk,” podcast, Brandi Kruse of “unDivided,” and Jonathan Choe, a senior fellow at the Discovery Institute. The Democratic House leadership denied their press passes earlier this year, arguing that the three figures actively participate in political advocacy rather than practicing journalism. House officials cited their involvement in hosting and speaking at political rallies and pushing specific policy agendas as disqualifying factors for credentials that grant access to Capitol areas closed to the public.
Attorney Jackson Maynard argued the denial violated his clients’ constitutional rights to free speech, free press, and due process. He told Judge Estudillo that the credential process was vague and arbitrarily applied based on political disagreement. “My clients are the eyes and ears of the people in the legislative process,” Maynard stated Monday, emphasizing that critical legislation including a multibillion-dollar budget faced votes within 72 hours. The three media figures filed their federal lawsuit specifically requesting emergency intervention before the session concluded.
