Federal immigration officials arrested a Guatemalan national convicted of sexually abusing a five-year-old child after Illinois authorities ignored an ICE detainer and released him back onto the streets, sparking a fierce confrontation between the Department of Homeland Security and Governor JB Pritzker over sanctuary state policies that critics say endanger American families.

Convicted Predator Walks Free Under Sanctuary Law

ICE officers conducted a targeted vehicle stop in Chicago to apprehend Erik Giovanni-Quiroa, who had served a three-year sentence for aggravated sexual abuse of a five-year-old before Illinois officials released him despite an active ICE detainer. Giovanni-Quiroa, who also carries a 2011 firearm-battery conviction, briefly fled from agents before being taken into federal custody. The arrest occurred only after ICE was forced to locate him independently when local authorities refused to honor the federal detainer request.

Assistant Secretary Lauren Bis delivered sharp criticism of Pritzker’s administration, questioning why no investigation exists into policies that allowed a convicted pedophile to walk free. “Governor Pritzker continues to refuse to do his job to protect his citizens from illegal alien crime and instead chooses to smear our law enforcement,” Bis told Fox News Digital. She called on the governor to “end this insanity and stop releasing pedophiles into our communities.”

Sanctuary Policy Clash Intensifies

Illinois operates under the TRUST Act, signed in 2017 by then-Governor Bruce Rauner, which prohibits state and local resources from being used for most civil immigration enforcement purposes. DHS reports more than 4,000 illegal immigrants currently sit in Illinois state custody. Governor Pritzker and Chicago Mayor Brandon Johnson have repeatedly attacked the Trump administration’s immigration enforcement efforts, with Johnson comparing President Trump’s America to Jefferson Davis’ Confederacy and accusing the administration of deploying DHS as a “private, militarized, occupying force.”

Giovanni-Quiroa illegally entered the United States during the second Bush administration and remained in the country for nearly two decades before his arrest on child abuse charges. ICE Director Todd Lyons previously contacted Illinois Attorney General Kwame Raoul urging state law enforcement to begin honoring ICE detainers. Federal officials argue that sanctuary policies in Illinois and other states wrongly protect criminal illegal immigrants, allowing them to reoffend and commit additional crimes against Americans. The case highlights the growing tension between federal immigration enforcement and state-level sanctuary policies that limit cooperation with ICE.
