A union representing Internal Revenue Service employees has filed an emergency lawsuit demanding a federal judge block an immunity agreement that would halt ongoing tax audits of President Donald Trump and his business operations, arguing the deal grants the president special treatment no other American taxpayer receives.
Union Challenges Presidential Tax Protection
The National Treasury Employees Union filed the updated complaint Thursday in federal court, asking U.S. District Judge Leonie Brinkema to prevent the Trump administration from implementing the immunity agreement. The union alleges the deal forces IRS employees to abandon active audits of Trump’s tax filings, effectively providing the president with what the lawsuit terms an unconstitutional financial benefit. Officials claim the immunity applies only to tax matters under examination at the time of the settlement and does not shield future tax returns from scrutiny.
National President Doreen Greenwald stated the integrity of America’s tax system rests on a fundamental principle that every taxpayer faces identical laws and standards. When political figures direct federal employees to treat certain taxpayers differently, it destroys public confidence in the system and places dedicated civil servants in impossible positions, she explained. The lawsuit contends the immunity agreement violates federal statutes prohibiting presidential interference with tax audits.
Judge Previously Blocked Related Administration Action
Judge Brinkema, overseeing the case in Alexandria, Virginia, previously blocked the administration in May from establishing a compensation fund. The union’s Thursday filing argues that earlier order does not go far enough to prevent future action on the fund. The complaint notes Trump has publicly stated his intention to keep the fund operational, affirming his belief that January 6 rioters and other beneficiaries should receive compensation for their experiences. The Justice Department and Trump’s legal team have not responded to requests for comment on the lawsuit.
Constitutional Questions at Stake
The legal challenge raises fundamental questions about equal treatment under tax law and whether any American, including the president, can receive immunity from standard IRS audit procedures. The union emphasizes that Trump and his family remain obligated to pay taxes owed like every other citizen. The case tests the boundaries of presidential authority over federal agencies and whether special deals can exempt specific individuals from routine tax enforcement actions. The outcome could establish precedent affecting how the IRS conducts audits of high-ranking government officials and their businesses going forward.
