A federal judge has denied defense motions to suppress evidence in what will become America’s first trial explicitly treating Antifa as a terrorist organization, delivering a significant victory to Department of Justice prosecutors.
Court Ruling Upholds Evidence Collection
Judge Pittman rejected attorneys’ attempts to exclude physical evidence seized during FBI searches, including firearms, ammunition, laptops, cell phones, and explosive materials. The evidence stems from a July 4, 2025, terrorist attack at a Texas Immigration and Customs Enforcement facility. Defense attorneys for defendants Arnold, Soto, and Sanchez Estrada argued that searches lacked probable cause, despite judicial approval of the warrants.
Public defender Christopher Weinbel acknowledged the ruling while maintaining his client’s position. “While I would stick by that belief, Judge Pittman made a good ruling,” Weinbel stated. “For all the flak he gets online, he is actually a pretty fair guy to be in front of.”
Nine Defendants Face Multiple Terror Charges
Nine individuals face charges, including riot, terrorism, attempted murder, firearm violations, and evidence tampering in connection with the coordinated attack. Prosecutors allege the group, led by fugitive Benjamin Song, organized travel to the ICE building, vandalized the facility, threw fireworks to lure police, and assisted Song’s escape after he fired shots at officers. Seven additional federal defendants previously pleaded guilty to belonging to an Antifa terror cell.
Historic Legal Precedent
The October indictment marks the first time federal prosecutors have formally designated Antifa as a terrorist organization. The DOJ described Antifa as “a militant enterprise made up of networks of individuals and small groups primarily ascribing to a revolutionary anarchist or autonomous Marxist ideology, which explicitly calls for the overthrow of the United States Government.” This language mirrors a September White House executive order addressing domestic terrorism threats.

EVERY SINGLE ONE OF THAT Organization needs to be Prosecuted and Convicted of Terrorism Crimes. Then their Home of Record needs to be Transferred to Guantnemo Bay.
They need to find out who is funding Antifa. My bet would be Soros funded organizations. If proven then they should also be indicted for terrorism.
