An Alabama jury is deliberating whether to sentence a woman to death after she shot and killed another pregnant mother in front of the victim’s children during a dispute over a man both women shared children with.
The Fatal Confrontation
Aaniyah Nowden, 24, was eight months pregnant when she shot Justina Wallace, 36, in the head in Birmingham in July 2023. Video evidence captured the moment Nowden fired at Wallace, who was holding her young daughter Sky while her other children stood just feet away. Wallace was rushed to the hospital but died the next day from her injuries. Nowden gave birth while in jail awaiting trial.
Prosecutors charged Nowden with three counts of capital murder of two or more people, capital murder of a child, and capital murder in the presence of children. The severity of the charges stems from Wallace being pregnant at the time of her death and the shooting occurring in front of multiple children. An earlier trial ended in mistrial due to insufficient jurors remaining after jury selection.
Self-Defense Claim Versus Prosecution
Nowden admitted to the shooting but claims she acted in self-defense, fearing for her life. Defense attorney Louvenia Borom argued that prosecutors presented only a partial picture and relied on biased witnesses, including two of Wallace’s sons who were eight and nine years old when they witnessed their mother’s killing. The defense characterized Wallace as aggressive and belligerent during the confrontation.
Deputy District Attorney Jason Wilson rejected the self-defense argument, emphasizing that Wallace held nothing but her baby daughter and carried no weapon. Fellow prosecutor Amanda Wineman told the jury that yelling at someone does not legally justify deadly force, calling the man at the center of the dispute a deadbeat who failed to support his children.
A Family Left Behind
Shamari Cooke, Wallace’s sister, described her as a devoted mother to five children who worked daily to build a better life for her family. The family celebrated Sky’s birthday just days after Wallace’s death, a painful reminder of the future the mother will never see. The case highlights the tragic consequences when personal disputes escalate to violence, leaving multiple children without mothers and families shattered by loss.
