A federal judge ruled President Donald Trump’s ban on three major news outlets likely violates the Constitution, ordering the White House to immediately restore press credentials for CNN, MS NOW, and Politico while their legal challenge proceeds through the courts.

Court Rejects Security Claims

U.S. District Judge Timothy Kelly issued a 14-day temporary restraining order Thursday morning, finding the outlets will likely succeed in their lawsuit on grounds their credentials were revoked without due process. The judge noted Trump did not dispute that the three organizations received no notice or opportunity to respond before losing White House access last week. Kelly dismissed the administration’s national security justification, pointing out Trump himself never mentioned security when announcing the ban on Truth Social Friday.

The President had declared the action necessary because of the outlets’ constant reporting of what he termed fake news. Kelly wrote that Trump instead focused on alleged lack of truthfulness and negativity in their coverage rather than any security concerns. The administration attempted to address due process issues Tuesday by sending letters allowing the outlets to contest the decision, but the judge found this insufficient after the fact.

Constitutional Showdown Over Press Freedom

Attorney Ted Boutrous, representing the three news organizations, called the ruling a strong vindication of freedom of the press, due process, and the rule of law. The outlets argued in their complaint that Trump’s own statements prove the ban was motivated by retaliation intended to intimidate them into changing their coverage and threaten other journalists. Trump told reporters in the Oval Office he barred the organizations not for any specific story but because of cumulative negative reporting over recent years designed to diminish Republicans.

The President had predicted before Wednesday’s hearing that Kelly, whom he nominated during his first term, would rule against him and pledged to appeal. Trump called Kelly totally disloyal and referred to his own directive as a ban on the free press. The three outlets reported their employees were initially denied White House access Thursday morning despite the court order, though whether this resulted from technical issues or noncompliance remained unclear. The White House did not respond to overnight requests for comment from NBC News.
