A federal immigration officer faces criminal charges after allegedly pointing his government-issued firearm at innocent motorists during a road rage incident while on duty, raising serious questions about federal accountability and the limits of claimed immunity.
Armed Federal Agent Admits Drawing Weapon
Hennepin County prosecutors issued an arrest warrant for Greg Morgan, an Immigration and Customs Enforcement officer, on two counts of second-degree assault. County Attorney Mary Moriarty announced the charges Thursday, detailing how Morgan drove on the road shoulder in early February while returning from his shift. When another vehicle briefly entered the shoulder before returning to its lane, Morgan pulled alongside and aimed his service weapon directly at two passengers through their closed windows.
In a revealing detail, Morgan admitted to Minnesota State Patrol investigators that he drew his firearm after the other vehicle had already returned to normal traffic flow. Prosecutors said Morgan claimed he yelled the word police at the passengers, but with their windows up, the occupants saw only a gun pointed at their heads with no identification of who was threatening them.
Federal Immunity Claims Rejected
When asked about Trump administration assertions that ICE officers enjoy absolute immunity while on duty, Moriarty delivered a direct response. There is no such thing as absolute immunity for federal agents who violate the law in the state of Minnesota or any other state, she stated. The case represents one of 17 investigations her office is conducting related to ICE operations during the Metro Surge immigration enforcement effort earlier this year, which resulted in multiple civilian shootings including two fatalities.
Federal Stonewalling Hampers Investigations
Prosecutors revealed they have no information about Morgan’s current whereabouts or employment status. The Department of Homeland Security has not communicated with local authorities about the incident or charges. In other Minnesota cases involving federal agents, DHS has blocked state investigators from accessing evidence, denying interviews with agents and refusing to share their identities. Minnesota Attorney General Keith Ellison accused DHS of deploying masked, armed paramilitaries who have killed two Minnesotans, calling the situation authoritarian. Road camera footage and Morgan’s own statements allowed this case to proceed while other shooting investigations remain stalled by federal obstruction.
