Patty Stemler, a veteran DOJ official handpicked by Attorney General Merrick Garland to consult on Trump-related investigations, sent an urgent email to Biden White House lawyer Sophia Brill on August 10, 2022—just two days after the raid. In the message obtained by Just The News, Stemler expressed alarm about the legal justification for the unprecedented action against a former president. She questioned whether the Justice Department had adequately considered Trump’s authority as commander in chief to declassify materials while still in office.

Stemler’s memo revealed she had no advance knowledge of the raid but grew increasingly concerned as details emerged. She specifically asked whether the National Security Division or the Office of Legal Counsel had examined Trump’s declassification claims. Drawing a parallel to presidential pardon powers, Stemler noted that while procedures exist for declassification, the president may not be bound by standard protocols given constitutional authority.

The Raid and Its Aftermath

More than three dozen armed FBI agents descended on Trump’s Florida residence in August 2022, seizing boxes of records. The operation, authorized by Garland, occurred months after the National Archives visited Mar-a-Lago and requested documents from the former president.
